The Fifth District Court of Appeals in Dallas, Texas affirmed the trial court’s prior ruling in favor of Wick Phillip’s client, a dentist and owner of a business condominium unit in Plano, Texas. The case originated with the owner of another unit in the condominium who filed suit against the builder and owners of the other units, alleging fraud, breach of fiduciary duty and conspiracy.
